At its heart, commercial conveyancing is the same process as residential conveyancing – the underlying law is the same. However, there are differences –
- Residential conveyancing is more standardised, particularly as regards what is acceptable or unacceptable to mortgage lenders.
- Commercial conveyancing tends to be more individual and customised, and it can be a lengthy process to get a lender’s decision on an unusual aspect
- There are far fewer statutory controls and rights, particularly where leaseholds are concerned
- Often, the conveyancing is linked to other legal work, such as the sale or purchase of a business as a going concern; this extra work needs to be dovetailed with the property conveyancing
